Terms and Conditions for Tech-Freedom for Visually Impaired
Welcome to Tech-Freedom for Visually Impaired App (the “App”), developed and owned by V.I. Developers (“we”, “us”, or “our”). By accessing and using this App, you agree to be bound by these terms and conditions (“Terms and Conditions”). If you do not agree to these Terms and Conditions, you should not use the App.
1. Intellectual Property Rights
The App and its entire contents, including but not limited to text, graphics, images, logos, button icons, software, and audio files (collectively, the “Content”), are the property of V.I. Developers and are protected by Indian copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or display any portion of the App or Content without our prior written consent.
2. App License
Subject to your compliance with these Terms and Conditions, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install and use the App on your Android device for your personal, non-commercial use.
3. Use of the App
You agree to use the App solely for its intended purposes and in compliance with all applicable laws and regulations. You further agree not to:
- Use the App in any manner that could damage, disable, overburden, or impair the App;
- Attempt to gain unauthorized access to any portion of the App, other accounts, computer systems or networks connected to the App;
- Transmit any virus, worm, spyware, or other harmful computer code, file or program through the App;
- Interfere with any other party’s use and enjoyment of the App;
- Attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the App.
4. User-Generated Content
The App may allow you to post or submit content, including but not limited to comments, ratings, and reviews (collectively, “User Content”). You retain all rights to your User Content, and you grant us a non-exclusive, perpetual, royalty-free, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.
You represent and warrant that your User Content does not infringe or violate the intellectual property rights, privacy rights, or any other rights of any third party, and that you have obtained all necessary licenses, consents, and permissions to post or submit such User Content. We reserve the right to remove any User Content for any reason, including without limitation, if we believe that such User Content violates these Terms and Conditions or is otherwise objectionable.
5. Privacy Policy
We respect your privacy and are committed to protecting your personal information. Our Privacy Policy, which is incorporated into these Terms and Conditions by reference, explains how we collect, use, and disclose your personal information when you use the App. By using the App, you consent to our collection, use, and disclosure of your personal information in accordance with our Privacy Policy.
6. Disclaimer of Warranties
The App is provided “as is” and without warranties of any kind, either express or implied. To the fullest extent permissible under applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will meet your requirements, or that the operation of the App will be uninterrupted, timely, secure, or error-free. We are not responsible for any errors or omissions in the App or Content, or for any damages or losses that may arise from the use of the App or Content.
7. Limitation of Liability
In no event shall V.I. Developers or its affiliates, partners, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App or Content, even if we have been advised of the possibility of such damages. Our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to use the App.
8. Indemnification
You agree to indemnify, defend, and hold harmless V.I. Developers and its affiliates, partners, officers, directors, employees, agents, and licensors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your User Content, or your breach of these Terms and Conditions.
9. Modifications to the App and Terms and Conditions
We reserve the right to modify or discontinue the App, or any portion thereof, with or without notice to you. We may also change these Terms and Conditions from time to time by posting the revised version on our website. Your continued use of the App following such changes constitutes your acceptance of the revised Terms and Conditions.
10. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without giving effect to any principles of conflicts of law. Any dispute arising out of or related to these Terms and Conditions or your use of the App shall be resolved exclusively through arbitration in accordance with the Arbitration and Conciliation Act, 1996, and the rules and procedures of the Indian Council of Arbitration. The arbitration shall be conducted in the English language and shall take place in New Delhi, India. The decision of the arbitrator shall be final and binding on the parties.
11. Miscellaneous
These Terms and Conditions constitute the entire agreement between you and V.I. Developers regarding the use of the App, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and V.I. Developers. If any provision of these Terms and Conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. No waiver of any provision of these Terms and Conditions shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.
12. Notices
We may provide notices or other communications to you regarding these Terms and Conditions or your use of the App by email, regular mail, or postings on the App. Any notices or communications from you to us shall be sent to the following email address: info@techfreedom.in.
13. Assignment
We may assign these Terms and Conditions, in whole or in part, at any time without notice to you. You may not assign these Terms and Conditions or transfer any rights to use the App or Content without our prior written consent.
14. Survival
The provisions of these Terms and Conditions that by their nature should survive termination shall survive any termination of these Terms and Conditions, including but not limited to provisions regarding ownership, disclaimers, limitations of liability, indemnification, and governing law.
